Terms and Conditions of Use

The Videohall website, “Videohall.com” is the web address for the interactive online service operated by TERC consisting of information services and content provided by TERC and other third parties. Your use of this website acknowledges acceptance of the following terms and conditions of use which apply to Videohall’s home page and its entire family of websites as indicated by the videohall.com.

Copyright and Use of Materials Posted on this Site

All content on the Videohall website is owned by TERC or its partners, or used by permission of the copyright holder, and is protected by copyright and trademark law. Unless otherwise stated, you may print or download a single copy of content (text and/or images) from the Videohall website for personal use provided that you keep intact all copyright and proprietary notices. You may not, however, reproduce, sell, or distribute multiple copies of any content – including text and graphics - without obtaining written permission from TERC in advance.

Although a variety of views and opinions are expressed on the Videohall website, unless otherwise stated these should not be interpreted as TERC’s official position.

Linking and Reuse of Videos

You may link to this website. Presenters have given their permission to the National Science Foundation and the following NSF Resource Centers: ARC, CAISE, CADRE, CIRCL, STELAR, CS For All Teachers, and MSPnet to reuse videos for educational purposes. Any other organization or individual who wishes to embed or reuse videos from this site should seek permission from the submitter of the video.

Use of This Site

We ask that you respect this Site and other users by not posting or transmitting any content that is inappropriate, damaging, infringing, or not in keeping with TERC’s mission.

  1. A participant shall use the Videohall website for lawful purposes only. A Participant shall not post or transmit through the Videohall website any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Videohall website’s express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a Participant that in the Videohall website’s sole discretion restricts or inhibits any other Participant from using or enjoying the Videohall website will not be permitted. Participants shall not use the Videohall website to advertise or perform any commercial solicitation.
  2. The Videohall website contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound. Except as expressly provided by the copyright holder and the terms of the applicable license, a user may not modify, publish, participate in the sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Except as expressly permitted in the applicable license, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. Participants acknowledge that it does not acquire any ownership rights by downloading copyrighted material, except as otherwise stated in the applicable license.
  3. All contributions made by a Participant to the Videohall website shall be subject to the terms and conditions of the Creative Commons Attribution Non-commercial No Derivatives license and this Agreement. This license is the most restrictive Creative Commons license, allowing redistribution. This license is often called the “free advertising” license because it allows others to download an author’s work and share it with others as long as they mention the author and link back to the author, but they can’t change it in any way or use them commercially. Participants shall not upload, post or otherwise make available on the Videohall website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with Member. The Member shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission, and hereby agrees to indemnify, defend and hold harmless the Videohall website for any and all claims, liabilities, damages and expenses arising from such infringement, including, but not limited to attorneys’ fees.

Submissions

If you submit content to the Videohall website through a discussion post or comment, or any similar interactive service on the Site, you give TERC the nonexclusive right to post such content publicly. TERC retains the right to modify or remove messages or other material that we consider inappropriate for any reason.

Security

Violations of system or network security are prohibited and may result in criminal and/or civil liability.

Privacy Policy

TERC is committed to protecting your privacy as explained in our Privacy Policy (below). Please review it carefully.

Support Level Agreement

TERC is committed to providing 24-hour availability to the Videohall website. However, despite the safeguards we have put in place, TERC cannot guarantee constant access to the Videohall website, and is not responsible for lost or delayed requests, email messages, or content.

Use Outside the United States

TERC cannot warrant that the Videohall website or the information contained therein may be lawfully accessed, transmitted, viewed, downloaded, or otherwise used outside of the United States. Users from outside the United States are solely responsible for compliance with the laws of the country from which access is made.

What Information Do We Collect?

When you visit our website you may knowingly choose to provide us with personal information about yourself. In addition to this individual information that you may provide to us voluntarily, we collect aggregate data on how you, and all our other visitors, make use of this site.

We will not sell, trade, or in any other manner intentionally distribute, disseminate, or disclose any personal identification information about you (such as, for example, your full name, email address, etc.) as an individual user of this website to any companies, organizations, individuals, or any other third party without having first received your permission.

We may request personal identification information from you in connection with your use of, or participation in, surveys, email correspondence, discussion boards, or participant registrations enabling participants to participate in online Videohall website events. However, we will only collect this personal information from you if you have voluntarily submitted it to us.

Should you contact us with questions or comments, we may use your personal information in order to respond to your questions or comments. We may also keep your comments or questions for future reference.

TERC enables site users to change or modify personal information by contacting the contact person listed on the website.

Exception

One exception to this policy is that we will release specific information about you to comply with any valid legal process requested by a search warrant, subpoena, statute, or court order.

Privacy of Children

TERC does not solicit personal information from minors. We will never knowingly request personally identifiable information from anyone under the age of thirteen (13) without prior verifiable parental consent.

If we become aware that a site visitor under the age of thirteen (13) has provided personal information without prior verifiable parental consent, we will remove his or her personally identifiable information from our files. Please note, we may maintain a record of that person’s name and address in a “do not register” file to prevent subsequent registration of that minor.

Non-personal Website Use Information

TERC automatically collects and stores information from each site visitor that is not personally identifying information. As each visitor browses through the website, reading and/or downloading pages, we will gather and store certain information about the visit. This information does not identify you personally. We automatically collect and store the following information about your visit:

  1. The Internet domain (for example, xcompany.com if you use a private Internet access account, or yourschool.edu if you connect from a school or university domain), and IP address (a number automatically assigned to your computer whenever you are online) from which you access our website.
  2. The type of browser and operating system you use to access our site, and other details about your software and hardware configurations.
  3. The date and time you access our site.
  4. The pages you visit within our site.
  5. If you came to our pages from another website, the URL of that website.

In addition, cookies may be used on some Videohall websites, but solely for purposes of authentication and/or personalization. We do not use cookies to gather information associated with an individual.

We use this non-personal information to help us make each of our websites more useful to visitors–to learn about the number of visitors to our site and the types of technology our visitors use.
